Government jobs me transfer life ka normal part hai. Policy ke mutabik, administration ko right hai staff ko jahan zaroorat ho waha post karne ka. Lekin ye power unlimited nahi; courts ne kuch guardrails set kiye hain.
Normally, transfer illegal challenge tab banta hai jab:
- It is clearly mala fide (punishment disguised as transfer),
- Policy/tenure norms ka crude violation ho without justification,
- Serious health or family hardship circumstances ignore kiye gaye ho,
- Repeated short-gap transfers se harassment pattern dikh raha ho.
Petitions me employees ko dikhana padta hai ki transfer sirf “administrative convenience” nahi, balki targeted action lagta hai – like whistleblowing ke baad immediate remote posting, ya refusal to obey illegal order ke baad punishment posting.
Courts generally reluctant hote hain minor transfers interfere karne me; wo HR managers nahi banna chahte. Lekin extreme arbitrariness, victimisation, or political pressure dikhe to intervention possible hai.
Employee ke liye best practice:
- Representation likhit me karo with medical/ family documents,
- Direct refusal ke bajay policy-based relief request karo,
Strong case ho tabhi high court tak jao; har transfer ko litigation issue bana dena career aur credibility dono ko hurt kar sakta hai.
