Problem tab aati hai jab probation endlessly extend hoti rahe, ya without reason employee ko confirm na kiya jaye.
Law yahan appointment letter, service rules, aur past practice sab consider karta hai. Agar:
- Probation period fixed thi aur woh expire ho gayi,
- Employer ne explicit extension ya termination order pass nahi kiya,
to kabhi-kabhi courts “deemed confirmation” ka concept apply karne ko ready hote hain, depending on wording.

Job ke initial stage me hi terms clear samajhna – “probation kitni, extension rules kya, confirmation criteria kya” – future dispute risk kam kar deta hai.
