Movies me aksar police station me “confession” ho jata hai, aur case khatam. Real law me itna simple nahi. Most systems police ke saamne diye gaye confessions ko direct evidence ke roop me bohot carefully treat karte hain, sometimes completely inadmissible bhi kar dete hain, kyunki torture, pressure, or inducement ka risk high hota hai.
General principle:
- Voluntary confession made before a magistrate after proper warnings and procedure has more evidentiary value,
- Police custody me diya gaya statement, especially without safeguards, suspicion se dekha jata hai,
- Co-accused ke confession se dusre logon ko convict karna akela sufficient nahi maana jata.
Law yeh bhi allow karta hai ki agar confession illegal tarike se obtain hua ho (torture, threats), to wo reject ho sakta hai, aur officials pe action bhi possible hai. Isliye investigation agencies ideally forensic, documentary, electronic, eyewitness evidence build karne pe focus karni chahiye, sirf confession pe nahi.
Accused ke liye practical tip: apne rights jaane, forced signing ya blank paper pe signature avoid kare, aur jaldi se legal counsel involve kare. Genuine, voluntary confessions bhi sometimes plea bargaining scenarios me strategically use hote hain, but blindly pressure me accept karna dangerous ho sakta hai.
