Log aksar notary stamp ko hi ultimate security samajh lete hain, lekin notarisation aur registration ka legal effect different hota hai.
Notarisation ka main role hai:
- Signatory ki identity verify karna,
- Ye confirm karna ki unhone document voluntarily sign kiya,
- Document ko future ke liye formally attested form me rakhna.
Ye helpful evidence hota hai, but khud se ownership transfer ya third-party rights create nahi karta, jahan law specifically registration demand karta ho.
Registration (usually at sub-registrar/land records office) kuch documents ke liye mandatory hoti hai – jaise sale deed of immovable property, certain leases, mortgages, etc. Registered documents public record ka part ban jate hain, jise koi bhi search kar sakta hai. Unka evidentiary value much stronger hota hai, aur unke bina transaction legally incomplete treat ho sakta hai.
Agar koi aapko kehta hai “property agreement notary se karwa lo, registration ki zaroorat nahi” – red flag. Short-term savings long-term disaster me convert ho sakti hai.
Rule of thumb:
- Important property and high-value transactions – registration check karo.
Routine declarations/affidavits – notary enough ho sakta hai, but context pe depend karega.
