Probate ek court order hota hai jo confirm karta hai ki deceased ka Will genuine hai aur executor ko authority deta hai Will ke hisaab se property distribute karne ki. Kuch areas me certain value se upar ke immovable properties ke liye probate mandatory hota hai.
Succession certificate usually debts and securities (bank balances, FDs, shares, bonds, etc.) ke liye hota hai jab Will nahi ho ya probate nahi liya gaya ho. Ye court-certified document hota hai jo batata hai kaun legal heir authorised hai amounts receive karne ke liye.
Banks and companies normally in documents ke bina large sums release nahi karte, kyunki unko double-payment ka risk hota hai. Proceedings me notices, publication, and objections ka chance diya jata hai taaki hidden claimants baad me na aa jaye.
